Sisco-Law successfully represented a group of Florida long term care facilities in relation to multiple appeals regarding the enforcement of arbitration provisions contained within nursing home admission agreements.
In one of the cases a trial court in Brevard County found the arbitration provision was not enforceable and Sisco-Law filed the appeal on behalf of its client. In three other cases, trial courts in Marion and Citrus counties determined the arbitration agreement was enforceable, and Plaintiffs appealed.
The 5th DCA ruled in a series of opinions that the arbitration provision at issue did not violate public policy and was enforceable.
