Christopher Starr was arrested in 2010 for trafficking in oxycodone and conspiracy to traffic in oxycodone. On May 18, 2011 he admitted his guilt and entered an "open plea" to charges which carry a mandatory minimum term of imprisonment of 25 years on each count.
Florida Statute 893.135(3) states, “adjudication of guilt or imposition of sentence shall not be suspended, deferred or withheld, nor shall such person be eligible for parole prior to serving the mandatory minimum term of imprisonment prescribed by this section.”
Despite the statutory requirements, and the denial under oath that he had been promised anything for his testimony in State vs. Gonzalez, Christopher Starr's sentencing has been contined sixteen (16) times by agreement between his Public Defender and the State Attorney's Office.
Christopher Starr is scheduled for sentencing on September 24, 2014. It will be interesting to see what is represented to the Court at his sentencing regarding the minimum mandatory sentence.
